The Board of Registration of Hazardous Waste Site Cleanup Professionals oversees hazardous waste site cleanup professionals, (“LSPs”), individuals who, by reason of appropriate education, training, and experience, are qualified, as attested by being licensed by the Board, to render waste site cleanup activity Opinions that can be relied on as sufficient to protect public health, safety, welfare, and the environment. See General Laws chapter 21A, § 19.
The LSP Board is comprised of eleven members. The Commissioner of the Department of Environmental Protection (“MassDEP”) or his/her designee serves as Chairperson. The remaining ten members are appointed by the Governor pursuant to General Laws chapter 21A, § 19A. Five (5) of the Governor’s appointees must be licensed LSPs. Three (3) others must be members of state-wide environmental organizations. One (1) must be a hydrogeologist. The final appointee is a member of a labor organization, who has experience with responses to releases of contaminants into the environment.
General Information to Candidates
Currently, the Board has one vacant slot which according to statute, must be filled by persons who are “. . . members of statewide organizations that promote the protection of the environment at the time of appointments and who are knowledgeable with respect to issues involving responding to releases of oil and hazardous materials.” See General Laws chapter 21A, § 19A. The appointee must have waste site cleanup experience i.e., assessment, containment, and removal as well knowledge of the Massachusetts General Laws chapter 21E Program, which tasks MassDEP with protecting the public health, safety, welfare, and environment with respect to the cleanup of hazardous waste sites in Massachusetts. The appointment is subject to confirmation by the Governor.
Statement of Responsibilities
The term of service is four (4) years. Board meetings occur monthly, except for the months of July and December. During meetings, LSP licensing matters, requests for approval of Continuing Education courses, and investigations of complaints lodged against LSPs who have potentially violated the Board’s Rules of Professional Conduct are reviewed by the Board members. Other matters including regulations revisions and examination are addressed through standing Committees.
