The Department of Labor Relations (DLR) has updated and revised its procedures for investigations, hearings, pre-hearing conferences, arbitrations, and mediations.

INVESTIGATIONS

Investigations will continue to be conducted remotely via WebEx.

PRE-HEARING CONFERENCES

Pre-hearing conferences will continue to be conducted remotely via WebEx.

HEARINGS AND ARBITRATIONS

Hearings will be held in person. The DLR will consider requests to allow witnesses to appear virtually. All such requests must be filed in writing with the hearing officer 14 days in advance of the hearing and must be supported by good cause.

Arbitrations may be held in person in the Boston office upon request of the parties. Everyone who is participating in the hearing must be physically present at the Boston office, and no one will be permitted to appear or observe the hearing remotely.

MEDIATIONS

Mediations may be held in person upon request of the parties. Absent agreement of the parties, mediations will take place by telephone or videoconference.
