Waiver Lists, Distributing Plans and Specifications, Accepting a Bid

The Prequalification Program emails the City/Town/Other Awarding Authority (OAA) an approved waiver list. The City/Town/OAA should distribute official plans and specifications only to prequalified contractors whose names appear on either the list of prequalified bidders or waiver list (if applicable). A City/Town/OAA should not accept a bid from a contractor who is not on the official bidders list or waiver list (if applicable).

The Waiver List

The waiver list is a list of prequalified contractors who have had a waiver request approved by the Prequalification Committee. A prequalified contractor whose name appears on the waiver list can receive official plans and specifications and can bid the project.

The waiver list is not a document requested by a City/Town/OAA. The Prequalification Program will email the City/Town/OAA the waiver list with an updated bidders list.

Should a subsequent waiver request from a contractor be approved by the Prequalification Committee prior to the bid opening time, the Prequalification Program will email the City/Town/OAA an updated waiver list with an updated bidders list.

When a prequalified contractor requests official plans and specifications, the City/Town/OAA should first review the most recent prequalified bidders list (and waiver list, if applicable) to confirm the contractor is on either the prequalified bidders list or waiver list (if applicable). A city/town/OAA should not give out official plans and specifications without the contractor being on the official bidders list or waiver list.

Who Can Receive Official Plans and Specifications

Only a prequalified contractor who is on either the prequalified bidders list or the waiver list can receive official plans and specifications. If a contractor is not on the prequalified bidders list or the waiver list, the City/Town/OAA should direct the contractor to contact the Prequalification Program at prequal.r109@dot.state.ma.us to find out how they can either get on the prequalified bidders list or obtain a waiver.

Accepting a Bid

To avoid a potential violation to the bidding process, a City/Town/OAA should not accept a bid from a contractor who is not on the official bidders list or waiver list (if applicable).
