400 CMR 6.00 Notice to Quit Attestation Form

Notice is hereby given, pursuant to Massachusetts General Laws chapter 30A, that the Executive Office of Housing and Economic Development (“EOHED”) is proposing to promulgate amendments to the regulations at 400 CMR 6.00 entitled “Notice to Quit Attestation Form” (the “Regulation”).

The Regulation implemented Section 1 of Chapter 257 of the Acts of 2020, An Act providing for eviction protections during the COVID-19 pandemic emergency (as amended by Chapter 20 of the Acts of 2021), which required, in part, that landlords provide a form containing certain information related to a residential tenant’s rights and available resources when giving a written notice to quit for nonpayment of rent.

The amendments to the Regulation implement sections 21 to 25 and section 30 of Chapter 42 of the Acts of 2022, an act making appropriations for fiscal year 2022 to provide for supplementing certain existing appropriations and for certain other activities and projects, that extend certain portions of the requirements of chapter 257 of the Acts of 2020 until March 31st, 2023.
