Disclosure reports data are self-reported to the Department by registered pharmaceutical and medical device manufacturers, who are operational in Massachusetts. This report contains data reported from 2009 to date in a searchable format. Please note that ‘payments’ made to Covered Recipients include any fee, payment, subsidy or other economic benefit with a value of at least $50. This dollar amount is not a total for the year but rather per instance.

Federal Disclosures
The Physician Payments Sunshine Act requires manufacturers of drugs, medical devices, and biologics that participate in U.S. federal health care programs to report certain payments and items of value given to physicians and teaching hospitals. The Centers for Medicare & Medicaid Services (CMS) has been charged with implementing the Sunshine Act and has called it the Open Payments Program.
Section 8 of the Massachusetts Pharmaceutical and Medical Device Manufacturer Code of Conduct, chapter 111N of the General Laws, requires the department of public health to make all disclosed data in annual reports publicly available and easily searchable on its website not later than 90 days following the receipt thereof.
In compliance with this mandate, this report shows the state-specific data received from the Open Payments Program. In addition to this federal data, the state also collects data for payments made to non-teaching hospitals and non-physician practitioners by pharmaceutical and medical device manufactures with marketing activity in the commonwealth. This annual data is reported separately and is available at https://www.cms.gov/OpenPayments/Data.
