What do I need to know about filing for an extension?

An extension of time to file will be granted automatically for a period of 6 months. A request for an extension of time to pay:

  • Is not automatic and
  • Must be submitted for review.

Additional requests for time to file and/or pay may be granted for an additional 6-month period. Such requests must be received on or before the expiration of the extended due date. An extension of time to pay may be granted for up to three years from the original due date of the return.

Filers are given an automatic extension of time to file the estate tax return if certain payment requirements are met.

Filers must have paid at least 80% of the tax finally determined to be due within nine months after the date of death of the descendant.

Failure to pay 80% of the tax due by the due date will:

  • Void any extension and
  • The return will be subject to a penalty for late filing back to the original due date of the return.

The estate tax return must be filed on or before the expiration of the extension period granted.
