Cape & Islands District Attorney Michael O’Keefe announced today that John Dias, IV (d.o.b.  2/2/1993) of Barnstable, was sentenced to 18 -20 years in state prison after having been found guilty on November 19, 2019, after a week-long trial in the Barnstable Superior court, of Aggravated Rape of  a Child with Force,  Kidnapping of a Child, Assault with a Dangerous Weapon, Aggravated Indecent Assault and Battery on a Child less than Fourteen years of age, and Witness Intimidation. 

 The charges stem from an incident which occurred on July 1, 2012, in the Town of Barnstable, in which the defendant entered a bathroom at Hamblin Pond Beach and forcibly raped and assaulted a thirteen year old child, while armed with a knife.

Today, November 22, 2019, the Honorable Judge Robert C. Rufo sentenced Dias to 18-20 years in state prison, to run from and after his current 8-10 year sentence. He was also sentenced to probation, to run from today and end ten years from and after his release from the committed portion of his sentence.  Terms of probation include the following: stay away and have no contact with the victim and her family or with children under 16; remain drug and alcohol free with screens; participate in sex offender treatment and restorative justice programming; register as a sex offender, and seek and maintain employment.  Upon his release, the court will hold a hearing to determine if GPS will be imposed.

The case was investigated by the Barnstable Police Department and prosecuted by Assistant District Attorney Jessica M. Croker.
