Delegated authority - Unoccupied buildings - i.e. pump stations/electrical substations

Hardship required:  Applicants must certify that they are unable to install any bathrooms due to space.

  1. Exceptions
    1. If building is has a gross space under 200 square feet - No bathroom required
    2. For buildings between 200 and 2,000 square feet - No bathroom required if there is an accessible bathroom within a  different building/structure located within 400 feet of the subject building's egress.  Alternatively, a new bathroom structure may be erected within 400 feet of the subject building, said bathrooms may utilize alternative technologies if compliant with 248 CMR 10.10(2)(h)
    3. Bathrooms are required for buildings 2,000 square feet or greater
  2. Other provisions
    1. If required, emergency showers/eyewash stations must be provided regardless of a bathroom variance
    2. Local Board of health must support variance request
