Hardship required: Applicants must certify that they are unable to install any bathrooms due to space.
- Exceptions
- If building is has a gross space under 200 square feet - No bathroom required
- For buildings between 200 and 2,000 square feet - No bathroom required if there is an accessible bathroom within a different building/structure located within 400 feet of the subject building's egress. Alternatively, a new bathroom structure may be erected within 400 feet of the subject building, said bathrooms may utilize alternative technologies if compliant with 248 CMR 10.10(2)(h)
- Bathrooms are required for buildings 2,000 square feet or greater
- Other provisions
- If required, emergency showers/eyewash stations must be provided regardless of a bathroom variance
- Local Board of health must support variance request
