Notice Inviting Comments on Proposed Amendments to Rule 19 (d)(1)(A) and (d)(2)(A) of the Massachusetts Rules of Appellate Procedure

The Standing Advisory Committee (SAC) on the Rules of Appellate Procedure solicits comments on proposed amendments on or before November 29, 2021.

The Standing Advisory Committee on the Rules of Appellate Procedure solicits comments on proposed amendments to Mass. R. App. P. 19(d)(1)(A) and (d)(2)(A).

The amendments would reduce the required number of paper documents filed with the Appeals Court. Specifically, where the rules permit a particular filing to be submitted to the Appeals Court in paper form (such as briefs, appendices, and, in civil cases, any exhibit volume or transcript volume), only a single copy would be required. In addition, the number of copies of each brief and appendix to be served on any counsel of record in connection with an appeal in the Appeals Court would be reduced from 2 to 1.

No changes are proposed to Rule 19(d)(1)(B) and (d)(2)(B), which concern appeals in the Supreme Judicial Court.
