Since the Appellant has also filed a discrimination complaint with MCAD, the Civil Service Commission is dismissing this appeal until MCAD has issued a final decision on the Appellant’s complaint.

The Superior Court affirmed the Commission's decision overturning the Westfield Fire Commission's decision to terminate the three Appellants.

The Commission concluded that the Appellant engaged in serious misconduct warranting serious discipline, but certain charges were not proven. For that reason, and because of issues related to disparate treatment, the termination was modified to a demotion and long-term suspension.

The Commission upheld a firefighter’s thirty-day suspension for failing to comply with two orders to attend medical examinations and two orders to meet with the Deputy Chief to explain the absences.

Since the Appellant has also filed a discrimination complaint with MCAD, the Civil Service Commission is dismissing this appeal until MCAD has issued a final decision on the Appellant’s complaint.

The Commission upheld two, eight-tour suspensions of a Boston firefighter for multiple instances of insubordinate and unbecoming behavior toward his peers and superiors, but overturned, due to mitigating circumstances, a third eight-tour suspension for two alleged instances of being AWOL.

The State Police had just cause to discipline the Appellant for failing to follow protocols related to outside employment, but the failure of the State Police to show repeated violations, as alleged, warranted a downward modification of the penalty.

The Superior Court issued a further decision clarifying what payments are due to Appellants for back pay, interest, etc.

The Commission allowed the appeal of a recently promoted Winchester Police Sergeant who was demoted to Patrol Officer primarily for his alleged mishandling of a an unusually complex hit-and-run incident. A preponderance of the evidence failed to establish he engaged in misconduct or serious violations of his duties.
