The Commission allowed the Appellant’s bypass appeal as the Springfield Police Department (SPD) did not show, by a preponderance of the evidence, that the Appellant failed to meet the civil service residency preference requirement, the sole reason offered by the SPD for bypassing the Appellant.

The Commission allowed the Appellant's appeal, concluding that he was aggrieved by an HRD decision not to restore him to an eligible list for promotion upon his reinstatement.

The Appellant, a Brookline Police Officer, filed an appeal contesting the decision of the Town of Brookline to bypass him for promotional appointment to Police Sergeant in favor of the brotherin-law of the Town’s Police Chief, who participated in the interview and selection process
