The City of Newton has proven by a preponderance of the evidence that it had reasonable justification to bypass the Appellant for original appointment to the position of permanent full-time police officer. based on the Appellant’s negative professional references, untruthfulness and unsuitability
The Commission upheld the City’s decision to bypass the Appellant as a reserve fighter based on the Appellant’s inconsistent and/or incomplete responses on her application and during her interview.
The City had just cause to suspend the Appellant for misconduct, including referring to her supervisor in obscene terms, but the level of discipline imposed was not justified. Suspension modified from 30 days to 10 days.
The Commission opted not to initiate an investigation regarding HRD's decision not to score the September 2022 police promotional examinations, citing the need to focus on the administration of the reformatted exams scheduled for September 2023.
