The Civil Service Commission finds that the City of Springfield had just cause to discipline the Appellant where his conduct was violative of the Springfield Fire Department Rules and Regulations.

The Civil Service Commission upheld the Springfield Fire Department’s decision to bypass the Appellant for Fire Captain based on his disciplinary history.

The Commission dismissed the Appellant’s bypass appeal since the Appellant was not bypassed during the hiring process for the Lawrence Fire Department.

Promotional bypass appeal allowed. The City's decision to bypass the Appellant for the position of Fire Captain was not consistent with basic merit principles and was the result of personal bias and bias based on the Appellant's sex. Absent an agreement by the parties, the Appellant is to be promoted to the position

Consistent with prior decisions, the Commission denied the Appellant' request to investigate HRD's decision to limit eligibility for a re-scheduled police promotional examination to only those candidates who had registered for the examination administered (but not scored) last year, as HRD's decision was not arbitrary
