Superior Court remanded case to Commission for additional findings.

Boston Police Department was not required to consider candidate for police officer who failed to sign Certification prior to deadline.

On remand, the Commission clarified why the Appellant's bypass appeal should be denied. His failure to provide HRD with an updated email address, and his failure to monitor the address he provided to HRD, resulted in him missing the deadline for signing the Certification.

The Commission granted the City of Holyoke’s Motion to Dismiss as the Appellant’s counsel failed to submit an opposition. The city argued that, as the Appellant had been a probationary employee at the time of termination, the Commission lacked jurisdiction to hear the case.

Promotional bypass appeal dismissed. The Appellant was not bypassed for appointment as no candidate ranked lower on the certification was promoted to Correctional Program Officer C (CPO C).

Based on the specific facts related to this appeal, the Commission dismissed the discipline appeal of a Gloucester Fire Captain, as the discipline imposed does not fall under the jurisdiction of the civil service law.
