The Commission scheduled a show cause conference to give the Town of Saugus the opportunity to show cause why the Commission should not initiate an investigation to investigate why the Town has failed to afford the Appellant the relief that was ordered to restore his rights under the civil service law.

The Commission accepted the bypass appeal of a candidate seeking original appointment to the Saugus Fire Department as the Town had mischaracterized his driving, employment, and criminal records. The candidate had a strong working history, excellent references, and a solid marriage and family life.

The Commission allowed the Appellant's bypass appeal for firefighter, concluding that the reasons for bypass were unsupported or contrary to basic merit principles.

To ensure enforcement of a prior Commission decision without impeding the City's ability to appoint firefighters, the Commission issued a clarification of the relief to be granted to the Appellant.
