The Commission dismissed the non-bypass equity appeal of a Holyoke fire lieutenant as he was unable to show that he was aggrieved by the City’s temporary use of an acting-out-of-grade appointment to fire captain.
The Commission affirmed the discharge of a Gardner Police Officer who was found to have pulled and aimed his taser at an uncooperative patient at a local hospital and then slapping him in the face. The Appellant failed to file a use of force report and lied to investigators about the incident.
Promotional bypass appeal allowed in part. The City erred by not considering the Appellant for promotional appointment, but, based on the unique circumstances referenced in the decision, only limited relief is warranted.
The Commission upheld the Boston Police Department's decision to bypass the Appellant for police officer based on his failure to provide a long list of required background information despite being given sufficient time to do so.
