Bypass appeal denied. The City of Lowell had reasonable justification to bypass the Appellant for original appointment as a police officer based on his prior failure to complete the Police Academy and his poor academic performance subsequent to his disqualification from the Academy.
A majority of the Commission granted the bypass appeal of a candidate seeking appointment as a police officer for the Boston Police Department. The candidate’s history of temporary ex parte restraining orders was not a reasonable justification for bypassing him, especially considering that the orders were dismissed.
The Superior Court dismissed a judicial appeal of the Commission's decision upholding an HRD determination related to the 2-point preference in promotional appeals for 25 years of service as the appeal was not timely filed with the Court.
Examination appeal related to two-point preference for 25 years of service denied. Time spent in Police Academy does not count toward the calculation of the required 25 years.
