Termination of police officer; appeal denied. By a 4-1 vote, the Commission found that the Appellant's off-duty misconduct related to domestic abuse provided the City with just cause to terminate his employment as a police officer, particularly in consideration of a recent last chance agreement.

The Commission adopted the recommended decision of the Magistrate and affirmed the decision to bypass the Appellant for police officer based on her failure to be forthcoming about certain aspects of her former employment.

The Commission allowed the Appellant’s bypass appeal based on the Town's failure to show a nexus between one incident of misconduct as a teenager and his ability to serve as a police officer.
