Discipline appeal denied. The Boston Fire Department had just cause to impose a 30-day suspension against the Appellant for his misconduct and the level of discipline imposed was consistent with progressive discipline.

The commission affirmed the suspension of a Boston firefighter for two tours after he engaged an avoidable confrontation with a contractor while working a detail and later told an overdramatized story about the situation. He also failed to follow standard operating procedures after the situation as required by BFD.

The 60-day suspension of a Boston firefighter was affirmed after the Commission found he abused his authority for personal gain as he parked his personal vehicle at a construction site and made an erroneous accusation of a welding foreman being drunk while working.

The Commission dismissed the appeal of a Registered Nurse who was terminated by the Department of Developmental Services as it concluded that it does not have the jurisdiction to hear her appeal.

The Superior Court affirmed the Commission's decision to uphold the bypass of a candidate for Gloucester firefighter due to his poor employment history.

By a 4-1 vote, the Commission's majority concluded that, notwithstanding flaws in the review process, the City was able to show, by a preponderance of the evidence, that the Appellant's problematic prior employment history justified his bypass for firefighter.
