Darmofal & Sniezek v. Town of Fairhaven & HRD 4/16/26

The Commission granted the Motion for Reconsideration filed by the Town of Fairhaven to incorporate into the Commission’s prior Decision the parties’ agreed form of retrospective and prospective relief designed to rectify the Town’s failure to comply with civil service law in making appointments and promotions.

The Commission ordered the Town of Fairhaven to rectify its failure to comply with civil service law in appointments and promotions made in the Fairhaven Police Department (FPD) and the Fairhaven Fire Department (FFD) on the Town’s erroneous assumption that it had removed the FPD and FFD from the applicability of c.31.

The Commission, after a thorough review of legislative history and the actions by the Town of Fairhaven, concluded that, based on the facts presented here, a Town Meeting vote was not sufficient to remove the Town from civil service as the Town originally adopted civil service through a ballot question.

Concluding that HRD’s decision to limit registration for the March 25, 2023 District Fire Chief examination to those who registered for the examination administered in May 2022 was permissible under the civil service law and was not arbitrary or capricious, the Commission dismissed the Appellant’s appeal.
