The Commission denied the Appellant’s non-bypass equity appeal after determining that he had no reasonable expectation of showing that DOC’s decision not to issue a third certification from the prior eligible list, upon which he appeared at or near the top, was meant to prevent the Appellant from being promoted.

The Commission allowed the appeal of a candidate whose appointment by the Mayor of Somerville to the position of Reserve Police Officer failed to receive confirmation of the Somerville City Council for reasons that involved unsubstantiated claims about the candidate’s alleged untruthfulness.

To ensure enforcement of a prior Commission decision without impeding the City's ability to appoint police officers, the Commission issued a clarification of the relief to be granted to the Appellant.

The Commission dismissed the appeal of a Peabody police sergeant who argued that another candidate was improperly awarded 2 points on a promotional examination as the issue is now moot based on the findings of a related investigation.
