After its own careful independent examination of the evidentiary record and applicable law, and notwithstanding a different recommendation from a DALA Administrative Magistrate, the Commission determined that the City of Methuen had established just cause to discharge a former Police Captain in Methuen.

The Commission upheld the promotional bypass of a police sergeant who had a consistent history of discipline over the course of his career as compared to the lower ranked candidate who had no disciplinary history, finding just cause to bypass him for promotion.

The Commission affirmed a 5-day suspension of a Westford police officer who engaged in a physical altercation with a fellow officer. The incident occurred because of the Appellant spreading false information about the other officer taking a personal day on a holiday which forced another officer to cover for him.
