The Commission upheld the promotional bypass of a police sergeant who had a consistent history of discipline over the course of his career as compared to the lower ranked candidate who had no disciplinary history, finding just cause to bypass him for promotion.
The Commission affirmed a 5-day suspension of a Westford police officer who engaged in a physical altercation with a fellow officer. The incident occurred because of the Appellant spreading false information about the other officer taking a personal day on a holiday which forced another officer to cover for him.
Since the Appellant has also filed a discrimination complaint with MCAD, the Civil Service Commission is dismissing this appeal until MCAD has issued a final decision on the Appellant’s complaint.
