Order of Dismissal
Earl Bagg appealed the State Board of Retirement’s denial of his application for accidental disability retirement, which was based on a negative medical panel. The State Board has now agreed to convene a new medical panel and PERAC has consented. The State Board has granted Mr. Bagg the same relief he would have been granted if he prevailed in his appeal. This makes his appeal moot, and I am therefore conditionally dismissing it. See 801 CMR 1.01(7)(g)3. The dismissal will become final by November 24, 2025 unless by that date Mr. Bagg files a request to keep the appeal open and states what issues remain to be resolved. If Mr. Bagg agrees with the dismissal, he need take no action.
