Order of Dismissal

Petitioner, Shawna Bernard-Lautieri, appeals from a decision of the Massachusetts Teachers’ Retirement System denying her application for Accidental Disability Retirement.

On October 16, 2024, the Division of Administrative Law Appeals (DALA) issued an order to show cause why Petitioner’s appeal should not be dismissed for her failure to file a prehearing memorandum by August 16, 2024 as ordered.  DALA instructed her to respond by November 15, 2024.  On November 12, 2024, DALA granted Petitioner an extension to

February 12, 2025 to file a memorandum.  On May 9, 2025, DALA granted her a further extension to June 27, 2025 to file a memorandum.  No response was received.

On January 15, 2026, I issued an order to show cause by February 12, 2026 demonstrating why Petitioner has failed to comply.  I indicated that if she failed to show good cause, her appeal would be dismissed.  Petitioner has failed to respond.

Accordingly, this appeal is dismissed for failure to prosecute.  801 CMR 1.01(7)(g)3.
