Petitioner Mary Connell Bettano appeals from a decision of the Saugus Retirement Board (SRB) relating to the return of her accumulated total deductions. On March 2, 2026, counsel for the SRB notified her that if she was not a member of a Massachusetts Contributory Retirement System and she wished to receive a return of her accumulated total deductions, the interest paid would be zero. Counsel notified Ms. Bettano that this was an appealable decision, and on March 17, 2026, Ms. Bettano filed an appeal.
On April 10, 2026, the Division of Administrative Law Appeals (DALA) ordered Ms. Bettano to file a memorandum by May 22, 2026, setting forth facts and argument supporting her contention that she is entitled to interest if she now withdraws her annuity savings. Ms. Bettano failed to do so. DALA then issued an Order to Show Cause, requiring her to state in writing by August 7, 2026, why she did not comply with the deadline. Ms. Bettano failed to respond.
In light of the foregoing, Ms. Bettano’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
