Order of Dismissal

Respondent the Massachusetts Teachers’ Retirement System (MTRS) denied petitioner Patrick Bzdula’s application to purchase retirement credit for a period of premembership work. Mr. Bzdula filed an electronic notice of appeal that provided no factual or legal information about the nature of the dispute.  Mr. Bzdula did not describe the circumstances from which his application and appeal arose. He did not say why he viewed MTRS’s decision as erroneous.

A prior order instructed Mr. Bzdula to file a memorandum and any exhibits discussing his circumstances and his claims.  The order advised Mr. Bzdula that his failure to comply would warrant dismissal of the appeal for failure to prosecute or failure to state a claim.  See 801 C.M.R. § 1.01(7)(g)(3).

Mr. Bzdula’s deadline under the prior order has expired.  He has filed neither a substantive response nor a request for additional time.  Accordingly, it is hereby ORDERED that this appeal is DISMISSED.
