Order of Dismissal

Petitioner Gisella Chiaravalloti appealed from the denial by the Waltham Retirement Board of her application for accidental disability retirement benefits (ADR). The Division of Administrative Law Appeals (DALA) ordered the parties to file a joint pre-hearing memorandum by August 5, 2026, which they failed to do. On July 30, 2026, counsel for Ms. Chiaravalloti filed a motion to withdraw, which DALA granted on August 19, 2026. DALA then ordered Ms. Chiaravalloti to indicate by August 24, 2026, whether she intended to proceed with her appeal and whether she had identified new counsel to represent her. She did not respond. DALA issued an Order to Show Cause why her appeal should not be dismissed for failure to prosecute. She again failed to respond. Accordingly, her appeal is DISMISSED for failure to prosecute. 801 CMR 1.01(7)(g)(2).
