The Petitioner appeals the Lowell Retirement Board’s denial of her application for accidental death benefits. The Division of Administrative Law Appeals (DALA) issued an Order to Show Cause in June 2023 because the Petitioner failed to file her prehearing memo. She responded to the order and DALA reset the deadlines. DALA issues a second Order to Show Cause in February 2024, again for failure to file her prehearing memo. The Petitioner responded and DALA reset the deadlines once more. On March 13, 2024, DALA issued a Third Prehearing Order asking her to file her prehearing memorandum by October 16, 2024. The order stated no further extensions would be allowed. No memorandum was filed, and she did not otherwise contact DALA.
I then issued a third Order to Show Cause on August 8, 2025 asking for a response by September 5, 2025. I indicated the matter would be dismissed if the Petitioner failed to provide a valid explanation. No response was received.
Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.
