Petitioner Jeffrey Crocker appealed the Methuen Contributory Retirement System’s denial of his request to change the named beneficiary for his Option C retirement plan from his ex-wife to his current wife. The Division of Administrative Law Appeals (DALA) issued a Scheduling Order dated June 18, 2025, requiring the Petitioner to file a memorandum to demonstrate that he could, post-retirement, change his Option C beneficiary from his ex-wife to his current wife. DALA did not receive a memorandum from the Petitioner.
On December 31, 2026, I issued an Order to Show Cause asking the Petitioner to file the requested memorandum on or before January 30, 2026, as well as to indicate why DALA should not dismiss his appeal for lack of prosecution. In that Order, I indicated that a lack of sufficient response may lead to the dismissal of his appeal. He did not provide any response.
Accordingly, I hereby dismiss the Petitioner’s appeal for lack of prosecution and failure to state a claim on which relief may be granted.
