Order of Dismissal
The Petitioner appealed the Boston Retirement System’s denial of his application for accidental disability retirement. DALA issued an order to show cause because the Petitioner failed to file a prehearing memorandum by January 17, 2025. DALA instructed the Petitioner to respond by June 27, 2025 and indicated the matter would be dismissed if he failed to provide a valid explanation. The Petitioner requested an extension to file a response, which was granted. He was given until September 30, 2025 to respond to the order to show cause or just file his prehearing memorandum. No response was received by that deadline.
Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.
