The Petitioner appealed the Massachusetts Teachers’ Retirement System’s (MTRS) decision denying your application to purchase prior out-of-state service. MTRS filed a motion to dismiss. It argued that this issue was already subject to an appeal before DALA. See Eastridge v. MTRS, CR-14-820. The Petitioner was given until August 8, 2025 to respond, but he did not. I then issued an order to show cause on December 29, 2025 asking the Petitioner to respond by January 30, 2026 as to why his appeal should not be dismissed. I indicated failure to respond would result in a dismissal. No response was received.
Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.
