Order of Dismissal
MTRS declined to treat pay Cheryl Eckert received in connection with an afterschool club as regular compensation. She filed a timely appeal. MTRS has informed me that it has now adjusted her retirement benefit to include that stipend as regular compensation.
MTRS’s action treating the stipend as regular compensation appears to make the appeal moot, and I am therefore conditionally dismissing it. See 801 CMR 1.01(7)(g)3. The dismissal will become final by April 20, 2026 unless by that date Ms. Eckert files a request to keep the appeal open and states what issues remain to be resolved. If Ms. Eckert agrees with the dismissal, she need take no action.
