Order of Dismissal
The Petitioner, Oscar Francisco, appealed the Boston Retirement System’s denial of his application for accidental disability retirement. The Division of Administrative Law Appeals issued a First Pre-Hearing Order dated April 16, 2025, requiring the Petitioner to file a Pre-Hearing Memorandum by August 20, 2025. He did not provide a response by the deadline. On December 1, 2025, I issued an Order to Show Cause asking the Petitioner to respond by January 9, 2026. In that Order, I indicated that I may dismiss the matter if he failed to provide a valid explanation. He did not provide any response by the deadline.
Accordingly, I hereby dismiss the Petitioner’s appeal for lack of prosecution. 801 CMR 1.01(7)(g)2.
