Order of Dismissal

On December 10, 2024, the Petitioner was ordered to show cause no later than January 17, 2025 why this appeal should not be dismissed for failure to state a claim upon which relief can be granted because he was attempting to appeal a retirement board advisory opinion over which DALA does not have jurisdiction.  See Bretschneider v. Pub. Emp. Ret. Admin. Comm’n., CR-09-701, at *2 (DALA Nov. 13, 2009).  The Petitioner was informed that failure to show cause meant that the appeal would be dismissed.

The Petitioner failed to respond to the Order to Show Cause. Accordingly, this matter is hereby DISMISSED.
