ORDER OF DISMISSAL

On May 27, 2026, petitioner Eric Gauvin appealed a decision of the State Board of Retirement (SBR) denying his application to purchase prior military service. The Division of Administrative Law Appeals (DALA) issued a Pre-Hearing Order that required Mr. Gauvin to file a pre-hearing memorandum by July 10, 2026. When he did not file that memorandum, respondent SBR filed a motion to dismiss. DALA then issued an Order to Show Cause requiring Mr. Gauvin to explain why he did not comply with the Pre-Hearing Order, noting that failure to provide this information could result in the dismissal of his appeal. Mr. Gauvin did not respond by the September 1, 2026, deadline. Mr. Gauvin’s appeal is therefore dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
