Order of Dismissal

Petitioner Nicholas Gerson seeks to buy back approximately 18 months of service after taking a refund of his annuity savings account after leaving state service and then re-entering state service.  The Board denied his application because its records did not reflect that he had returned to state service yet.  Mr. Gerson timely appealed. 

The Board now represents that its records reflect that Mr. Gerson had indeed returned to state service on the date of his application and that consequently it will process his application.  There being nothing further in dispute, the Petitioner’s appeal is moot.

Accordingly, this appeal is dismissed.
