Petitioner is seeking to purchase her contract service with the Attorney General’s office from March 1984 to July 1985 under G.L. c. 32, § 4(1)(s). From July 1985 through August 10, 1998, she was a regular employee of the Attorney General’s office. On October 7, 1988, Petitioner withdrew the accumulated deductions taken for the period that she was a regular employee.
On November 17, 2025, Petitioner was ordered to show cause no later than December 5, 2025 why this appeal should not be dismissed for failure to state a claim upon which relief may be granted. I explained to her that the retirement board’s contract service regulation, 941 CMR 2.09(3)(e)(2), does not allow the purchase of contract service that precedes a period of membership service for which she took a refund of her accumulated retirement contributions.
The Petitioner failed to respond to the Order to Show Cause. Accordingly, this matter is hereby DISMISSED.
