Order of Dismissal

Petitioner Alexander Goodstein appealed the State Board of Retirement’s denial of his request to purchase prior non-membership service as a seasonal employee during the summers of 2002 through 2006. Ms. Goodstein worked between 55 and 97 days each summer. The SBR denied his request pursuant to its regulations that prohibit the purchase of “prior non-membership service of less than six consecutive months which was part-time, provisional, temporary, temporary provisional, seasonal or intermittent that occurred after January 28, 1993 and was not immediately followed by membership service[.]” 941 CMR 2.04.

On January 27, 2026, I issued an Order to Show Cause why his appeal should not be dismissed for failure to state a claim on which relief may be granted. In that Order, I indicated that I may dismiss the matter if he failed to provide a sufficient response by February 20, 2026. He did not respond by the deadline.

Accordingly, I hereby dismiss the Petitioner’s appeal for failure to prosecute. 801 CMR 1.01(7)(g)(2).
