Order of Dismissal

The Petitioner appealed the Boston Retirement System’s decision denying his application for accidental disability retirement. The parties were asked to file a pre-hearing memorandum in 2023. When none was filed, DALA reached out to counsel. The Petitioner’s attorney indicated she no longer represented him and did not know whether he wished to pursue the appeal. On February 2, 2026, I sent the Petitioner a notice to file the pre-hearing memorandum by March 20, 2026. After no response was received, I issued an order to show cause asking why the case should not be dismissed for failure to prosecute. I indicated failure to respond would result in a dismissal. To date, DALA has not received a reply. Nor is there any indication the Petitioner wishes to pursue this appeal. Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.
