Order of Dismissal
The State Board declined to treat Troy Kelley’s job as a Rehabilitation Counselor D at the Lemuela Shattuck Hospital as a Group 2 position. He filed a timely appeal. The State Board has now approved a pro-rated group classification for Mr. Kelly that will grant him an 80% retirement benefit, which means that a decision on the Group 2 issue appealed will be of little consequence. Both the Board and Mr. Kelley request that his appeal be dismissed.
The agreement of the parties to the pro-rated resolution and their mutual desire that the appeal be dismissed makes the appeal moot, and I am therefore dismissing it. See 801 CMR 1.01(7)(g)3.
