Order of Dismissal

This is an appeal by the Petitioner of the Hampshire County Retirement Boards’s denial of his application to purchase prior military service. After I issued a decision, the matter was remanded by CRAB due to the passage of the HERO Act. Following remand, I issued an Order to Show Cause asking why the appeal was not moot. The Board responded and indicated the Petitioner is no longer a member of the Hampshire County Retirement System; it argues the case is moot because of that and passage of the HERO Act. The Petitioner did not respond to the Order to Show Cause (nor to a prior Order to Provide a Status Update). The Petitioner was advised that failure to respond would result in dismissal of the appeal for failure to prosecute.

Accordingly, it is hereby ORDERED that the appeal is DISMISSED
