Petitioner Stephen Landry appeals from a decision of the State Board of Retirement (SBR) denying his request to have his job at MassAbility classified as Group 2. After receiving his appeal, the Division of Administrative Law Appeals (DALA) ordered Mr. Dwyer to submit a pre-hearing memorandum by April 30, 2026. He did not do so. On June 2, 2026, the SBR filed a motion to dismiss for failure to prosecute under 801 CMR 1.01(7)(g)(2). DALA then issued an Order requiring Mr. Landry to file a written response to the motion to dismiss by July 1, 2026. Mr. Landry again did not respond. Nor did Mr. Landry respond to DALA’s September 3, 2026, Order to Show Cause requiring him to explain by September 29, 2026, why he did not comply with the Order. In light of the foregoing, Mr. Landry’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
