Order of Dismissal

Petitioner John Legere appealed the State Board of Retirement’s (SBR) denial of his request to purchase service with the University of Massachusetts Medical School for the period of February 28, 2011, to March 30, 2021.  The Division of Administrative Law Appeals (DALA) issued a First Pre-Hearing Order dated October 31, 2025, requiring the Petitioner to confer with SBR’s counsel by December 5, 2025, and for the parties to submit a Joint Pre-Hearing Memorandum by February 6, 2026.  SBR’s counsel, Yande Lombe, informed me that she did not hear from the Petitioner by that date or thereafter. On February 12, 2026, I issued an Order to Show Cause asking the Petitioner to respond by March 17, 2026, with a written response explaining why he did not comply with the Order. In that Order, it was stated that a lack of sufficient response may lead to the dismissal of his appeal. No response was received by the deadline.

Accordingly, I hereby dismiss the Petitioner’s appeal for lack of prosecution.  810 CMR 1.01(7)(G)2.
