Order of Dismissal

Petitioner McCarthy filed two appeals seeking to purchase creditable service with the Middlesex Sheriff’s Department from 02/01/2011 to 03/07/2014 and prior non-membership service with the Town of Malden for time periods of 2006 to 2010. On January 6, 2025, I sent him an order to show cause why his appeal should not be dismissed due to his failure to submit a prehearing memorandum by November 9, 2024 as ordered.  I gave him until February 7, 2025 to respond.  No response was received.

Accordingly, this appeal is dismissed for failure to prosecute.  801 CMR 1.01(7)(g)3.
