The Petitioner appealed the Massachusetts Teachers’ Retirement System’s (MTRS) decision denying to waiver certain interest charges. The parties were ordered to file a joint memorandum. Before the deadline passed, MTRS filed a motion to dismiss arguing the Petitioner’s appeal was untimely. The Petitioner was then ordered to file both her memorandum and a response to MTRS’s motion. The Petitioner did not respond by the due date of July 25, 2025. I then issued an order to show cause on December 29, 2025 asking the Petitioner to respond by January 30, 2026 as to why her appeal should not be dismissed. I indicated failure to respond would result in a dismissal. No response was received.
Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.
