Order of Dismissal
David McLaughlin timely appealed from the Middlesex County Retirement System’s (MCRS) denial of his request to retroactively reinstate his accidental disability retirement allowance. The MCRS has now moved to dismiss his appeal, stating that it retroactively reinstated his allowance. The MCRS also provided documentation showing that it paid Mr. McLaughlin for the missed monthly allowance.
The MCRS’s retroactive reinstatement of Mr. McLaughlin’s allowance makes the appeal moot. I am therefore conditionally dismissing the appeal. 801 CMR 1.01(7)(g)(3). This dismissal will become final unless Mr. McLaughlin files a request before April 24, 2026, to keep the appeal open and states what issues remain to be resolved. If Mr. McLaughlin agrees with the dismissal, he does not need to take any action.
