Decision  Morales v. Boston Ret. Syst., CR-26-0096

Date: 08/21/2026
Organization: Division of Administrative Law Appeals
Docket Number: CR-26-0096
  • Petitioner: Fundador Morales, Jr.
  • Respondent: Boston Retirement System
  • Administrative Magistrate: Judi Goldberg

Order of Dismissal

Petitioner Fundador Morales, Jr. appeals from the February 18, 2026, notice from the Boston Retirement System (BRS) denying his request to retire with accidental disability retirement benefits. As the basis for its denial, the BRS informed Mr. Morales there was a majority negative medical panel certificate, which required it to deny his application. Mr. Morales appealed this denial on March 2, 2026.

On March 12, 2026, the Division of Administrative Law Appeals (DALA) issued an Order that required Mr. Morales to file a pre-hearing memorandum by April 24, 2026. Mr. Morales failed to do so. DALA then issued an Order to Show Cause, requiring him to state in writing by August 7, 2026, why he failed to comply with the deadline. Mr. Morales failed to respond.

In light of the foregoing, Mr. Morales’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
