Order of Dismissal

The Petitioner filed a timely appeal of the Hampshire County Retirement Board’s denial of his application for accidental disability retirement. Just prior to a scheduled deadline, on April 24, 2024, his sister sent an e-mail to the Division of Administrative Law Appeals (DALA) indicating he had a recent medical issue that made it difficult for him to participate in his appeal. Given this information, DALA placed the case on hold. Instead, Magistrate Rooney asked the Petitioner (or his sister) to provide a status by November 1, 2024. No update was provided.

Then, on July 8, 2025, I sent an e-mail to all parties, including the Petitioner’s sister, and asked that they provide an update on where things stand by July 28, 2025. Again, no update was provided. I therefore issued an order to show cause asking why the case should not be dismissed. The deadline for a response was August 29, 2025. No response was provided.

DALA has not received any communication from the Petitioner (or his family) since April 2024 despite repeated requests and an order to show cause. Accordingly, the case is dismissed for failure to prosecute.
