On April 7, 2026, petitioner Robert Mosher appealed a decision of the State Board of Retirement (SBR) denying his application for accidental disability retirement. The Division of Administrative Law Appeals (DALA) issued a Scheduling Order that required Mr. Mosher to file a memorandum to support his position by June 30, 2026. When he did not file that memorandum, respondent SBR filed a motion to dismiss. DALA then issued an Order to Show Cause requiring Mr. Mosher to explain why he did not comply with the Scheduling Order, noting that failure to provide this information could result in the dismissal of his appeal. Mr. Mosher did not respond by the August 26, 2026, deadline. Mr. Mosher’s appeal is therefore dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
