Decision  Murphy v. State Bd. of Ret., CR-26-0134

Date: 08/21/2026
Organization: Division of Administrative Law Appeals
Docket Number: CR-26-0134
  • Petitioner: Joseph Murphy
  • Respondent: State Board of Retirement
  • Administrative Magistrate: Thomas E. Bocian

Order of Dismissal

Petitioner Joseph Murphy appeals from the State Board of Retirement’s determination that his position did not qualify for Group 4 classification.  See Mass. Gen. Laws ch. 32, § 3(2)(g).  On June 8, 2026, the Division of Administrative Law Appeals entered an order to show cause why petitioner’s appeal should not be dismissed owing to his failure to submit a prehearing memorandum by May 22, 2026, as previously ordered.  Petitioner was given until July 8, 2026 to respond to the show-cause order.  No response was received.

Accordingly, this appeal is dismissed for failure to prosecute.  801 CMR 1.01(7)(g)(3).
